CCTV & Alarm System Terms and Conditions


1. DEFINITIONS & TERMINOLOGY

Griffiths Security and Smart Technology,”GRIFFITHS SECURITY AND SMART TECHNOLOGY”,us, our and we all refer to the organisation responsible for carrying out the installation, design, and maintenance of the installation and is the subject of this contract. “The customer” is the person or organisation being a signatory to this CONTACT, sometimes referred to as “you” or “your” in these Terms and Conditions

“The premises or property” are the premises described in the site survey or quotation.

“The installation” is the alarm system or CCTV system that is defined or described in the quotation or specification.

“Contract” means the quotation, specification or maintenance, and acceptance together with these Terms and Conditions.

“Specification” means the design specification which outlines the capabilities of the alarm system or CCTV system along with technical aspects and described system features. This forms the main basis of the “contract” or “quotation” and is the proposed price for providing goods, services and labour that includes installation or maintenance.

The quotation and contract is itemized and the official quotation provided by Griffiths Security and Smart Technology.

“Sign off form” refers to the installation being agreed as completed by the customer either by means of a written document or form, payment by the customer or verbal/written conformation that the customer is using the system for the intended purpose.

2. WARRANTY

i) Annual servicing needs to be completed or provisionally booked to validate any outstanding warranty on equipment. This is waived if the maintenance is booked in with us but not yet completed. The annual maintenance will need to have been booked before the fault occurred.

ii) We guarantee all our products to be free defects in workmanship and material for 1 year, unless otherwise specified, from the day customer receives their installation or takes delivery of the item. We will replace or refund items providing there is no evidence of CUSTOMER misuse or alteration.

Products with a 3 year warranty is warranty provided by the manufacturer on the equipment. This does not cover our call out charge after the first 12 months. The 3 year warranty is provided minus any time we have had the equipment in our possession prior to installation limited to 6 months. We will arrange any repairs/replacement with the manufacturer/supplier on your behalf. Warranty is 1 year ‘return to base’ if faulty, the fault will need to be adequately described and demonstrated to our engineer. We cannot respond to reports that do not describe the fault adequately as we cannot rule out user error.

Exclusions:

Any item or product that is deemed as a “consumable” is excluded from our warranty. This includes all of the below but the list is in no means exhaustive.

User error:

We will try to mitigate any user area by asking questions about the fault to rectify remotely at no cost to the customer, we are always happy to help. However if the call or fault reported results in a call-out at our expense the call-out will be chargeable at our standard call-out rate of £45 per hour with a minimum 1 hour charge. Hours are always rounded up to the next hour for EG a call out taking 1.25 hours will have a charge of 2 hours.

The warranty on goods supplied is for the isolated operation independent of remote data connection IE connection via the internet via phone apps or laptops and PC’s

PLEASE BE ADVISED WE CAN NOT WARRANTY OR GUARANTEE AGAINST ISSUES WITH THE INTERNET CONNECTION AND SERVICES THAT FAIL DUE TO THE INTERNET CONNECTION MADE AVAILABLE BY THE CUSTOMER WHICH INCLUDES PROBLEMS WITH THE ISP.

Remote playback and remote viewing:

The performance of playback and remote viewing from a mobile device is dependant on the quality of the data, wifi or 3/4/5G connection to the mobile phone and the upload speed and bandwidth of the local router provided by the ISP. This performance is outside of our control and outside of the scope of our support or warranty.

App Notifications:

We are happy to set up video based notifications for the CCTV app if the system affords those features and set up a range of different analytic features, also if available. We cannot guarantee the reliability of notifications sent from a CCTV systems to a mobile app due to a number of variables which include:

3. COMPANY OBLIGATIONS

i) We will always ensure that the system is handed over in a working condition and is functional at the time of payment and before payment is requested.

ii) Workmanship: if workmanship is found to be faulty within the first 12 months of the system being installed we will rectify the workmanship free of charge to the customer provided the equipment and cabling infrastructure has not been changed or damaged.

5. QUOTATIONS

Quotations are valid for a period of 30 days from the date of issue. Quotations are based on information given & should not be considered as system design. Any quotation ether verbal or in writing is not an offer & may be withdrawn or modified at any time by GRIFFITHS SECURITY AND SMART TECHNOLOGY. The entire risk to the results & performance of the system design is assumed by Griffiths Security and Smart Technology/person quoted. GRIFFITHS SECURITY AND SMART TECHNOLOGY disclaims, ether expressed or implied, including but not limited to, merchantability, fitness for a particular purpose, title & non- infringement arising out of any quotation/proposal. GRIFFITHS SECURITY AND SMART TECHNOLOGY shall not be liable for any loss of data, loss of production, loss of profit, loss of use, loss of contracts or any other consequential, economic, or indirect loss whatsoever.

6. CUSTOMER OBLIGATIONS

i) You agree to give us and our workers full access to your PREMISES to survey, measure, install, test and service the equipment. You also agree to provide an adequate electricity supply for the equipment to operate correctly. If our work is interrupted or delayed because of a problem with access, or the electricity supply is inadequate, we may make an extra charge. We are not liable if completion is delayed due to the circumstances beyond our control. By signing the CONTRACT with us, you guarantee that you have full authority to allow the installation and no other consent is needed.

ii) The equipment does not belong to you until it has been paid for in full. If you do not pay the balance of the installation charge when due we, have the right to remove the equipment from you PREMISES without notice. By signing this CONTRACT with us, you irrevocably authorize us to enter your PREMISES to remove the equipment if payment remains outstanding.

iii) If you cancel our CONTRACT less than a week (4 calendar days) before the scheduled installation date, we may charge you for any equipment we have bought for your PREMISES and make a reasonable charge for damages for breach of CONTRACT. However, a general cancellation fee of a minimum £100 or 15% of the contracted amount, whichever is greater, shall be charged.

7. REMOTE VIEWING & IT ISSUES

If we are unable to configure the remote viewing on the day of the scheduled installation due to IT technical issues, ISP unavailability or lack of details such as Router IP address, lack of WIFI extender/access point, user name & password then further charges will apply to remotely configure or revisit to complete the setup. Griffiths Security and Smart Technology cannot be held liable for CLIENT IT issues such as change of router, failed connection, change of Internet service provider, reset of router, new mobile phone, loss of settings on the router or a new operating system.

8. ALARM YEARLY SUBSCRIPTION

The enforcer V10 alarm system has a £35 yearly charge for the mobile app notifications & features, GRIFFITHS SECURITY AND SMART TECHNOLOGY provide the first year free as a trial, After 1 year the subscription will expire and notifications & mobile features will be disabled. Subscription is optional but is also included in the recommended annual service which will be priced according to the size of your system. Number of detectors and contacts etc.

9. PROPERTY DAMAGE AND ALTERATION

By accepting the quotation the customer agrees that in order for the installation to take place we may have to drill and cut into the fabric of the building, we will always try to “make good” any damage caused and leave the building in a good condition. Any holes drilled will be filled but any finishing off and decoration is the responsibility of the customer. Any plastics that are drilled will be repaired with a suitable plastic cover in a colour of white or black but not replaced. This includes fascia boards and soffits.

10. CUSTOMER SATISFACTION

GRIFFITHS SECURITY AND SMART TECHNOLOGY endeavour to maintain a 100% satisfaction from our customers. If you are not happy with your installation or the equipment supplied please apply in writing to our head office address or email rhys@griffithssecurity.com and we will deal with the complaint within 3 days, if this is not possible for any reason we will reply within 3 days and explain why and how we will proceed. Internet issues unfortunately cannot be considered as we are not the providers of this service and encourage this type of problem to be referred to your internet service provider/ISP.

11. LIABILITY

i) Griffiths Security and Smart Technology Griffiths Security and Smart Technology shall not be liable for the costs of any work, repairs or replacement of equipment which results from fire, electrical power surge, storm, flood, accident, neglect, misuse, or malicious damage.

ii) Griffiths Security and Smart Technology does not warrant or represent that the operation of the installation will be uninterrupted or error free. Griffiths Security and Smart Technology provides the system to ASSIST in the security of the CUSTOMER’s PREMISES but does not thereby warrant the security of the property, the CUSTOMER, or the contents therein. Griffiths Security and Smart Technology does not act and shall not be deemed to act as an insurer of the CUSTOMER’s property or contents contained therein and give no warranty by virtue of the installation of the system, the property or contents contained therein are completely secure or invincible. Griffiths Security and Smart Technology shall have no liability in CONTRACT for any loss suffered and in particular Griffiths Security and Smart Technology does not accept any liability whatsoever for any consequential loss or damage (including loss of earnings or profits) which may arise from any malfunction or defect of the system. A security system provided by Griffiths Security and Smart Technology is to aid the security of the premises but is by no means intended to be the sole protection of the property or premises.

iii) The Terms and Conditions given in the CONTRACT do not affect your rights under the Sale of Goods Act of Unfair CONTRACT Terms Act.

11. RIGHT OF ASSIGNMENT

Griffiths Security and Smart Technology shall be entitled to assign all or any of its rights under this agreement and to perform any of its obligations through subcontractors. The CUSTOMER’s rights under this agreement are not assignable or transferable with the prior written consent of Griffiths Security and Smart Technology.

12. PAYMENT OF GOODS/INSTALLATION

A payment date will always be stated on the invoice. For commercial customers this is generally between 7 and 30 days after installation, all bookings will require a 10% deposit, which will be taken on booking an installation date. ALL Domestic customers invoice date will be the date of installation and we require payment before the installer leaves your premises. The invoice will have a due date of “On Completion” or “Immediate” .There may be some circumstances where, at our discrepancy, we may adjust this. Products remain property of GRIFFITHS SECURITY AND SMART TECHNOLOGY until paid for in full.

13. LATE PAYMENTS

GRIFFITHS SECURITY AND SMART TECHNOLOGY have the legal right to charge interest on late payments. An invoice will state an agreed date of payment between GRIFFITHS SECURITY AND SMART TECHNOLOGY and the customer.

If payment to us is overdue, we will charge you interest at 2% over the base rate of National Westminster Bank, from the date of our invoice until the date you pay PLUS a late payment fee of £99.00

Should you refuse to pay the money plus any interest and late payment fee due to us, we will transfer the payment collection to a debt recovery agent or solicitor. The additional costs of the debt collection and any legal and court fees will also apply. Regarding both commercial and domestic/public; reminders and charges will continue to occur until we pass over the debt to a debt recovery agency. Late payments and debt recovery information can be found on the Government website, you can find the rights, of us as business and you as a customer, there for your perusal.

12. FORCE MAJEURE

Griffiths Security and Smart Technology shall not be liable for any failure of or delay in the performance of this Agreement for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labour disputes, embargoes, government orders or any other force majeure event.

13. APPLICABLE LAW

This CONTRACT is governed by the laws of England and Wales, Scotland or Northern Ireland as the case may be and each party submits to the jurisdiction of the courts thereof.
